AskGartner Terms of Use

AskGartner is an additional feature provided to facilitate access to Gartner.com research. It is not a separate service offering. Use of AskGartner is governed by these participation terms (“AskGartner Terms”) and your existing agreement with Gartner, and does not create any new or separate entitlement to Gartner products or services.

As a condition of participation, you acknowledge and agree that your use of AskGartner is subject to the following AskGartner Terms:
 

1. Eligibility: You attest that your organization (“Client”) is in good standing and under current contract with Gartner and that you are authorized to sign in to Gartner.com on your organization’s behalf.
   
   
2. Use of Client Data by AskGartner: Gartner will not use any Client data, including but not limited to user inputs and outputs generated by AskGartner, to train, retrain, or otherwise inform the underlying artificial intelligence LLM powering AskGartner. While Gartner may use Client prompts and interactions to enhance and refine the user experience of AskGartner, such use does not extend to training or improving the underlying LLM itself.
   
   
3. Ownership and License Grant:
   
   By Client: Client retains ownership of all pre-existing Client data and intellectual property (“Client IP”) disclosed in connection with the use of AskGartner and its feedback on AskGartner (“Client Feedback”) and grants to Gartner a license to use the Client Feedback, as noted in the AskGartner Terms.:
   
   By Gartner: Gartner retains ownership of AskGartner and all Gartner intellectual property and proprietary materials disclosed in connection with AskGartner (collectively, the “Gartner IP”), and grants to Client a non-exclusive, non-sublicensable, non-transferable license to use AskGartner and any generated output, for personal, non-commercial use only and to fulfill its obligations hereunder, subject to the following:
   
   
   • Client will adhere to, and will ensure its use of AskGartner complies with, all AskGartner guidelines, applicable laws, and regulations.
     
   • Client will not use AskGartner or its output to develop or distribute generative applications or products or services, or reverse engineer AskGartner in any way that competes with Gartner’s products and services.
     
   • Client will not, and will not permit any third party to, distribute, disclose, offer for sale, sell, lease, or provide access to AskGartner or its output.
     
   
   
4. Confidentiality: Each party agrees to treat the proprietary, non-public information disclosed by the other party as confidential and not to disclose it to any third party.
   
   
5. Access to Client Data: Gartner may share information about your use of AskGartner (e.g. prompts, feedback) internally to those individuals who need such access to deliver and improve Gartner products and/or services, or to recommend other Gartner products or services to you. Unless otherwise specified prior to collection, Client data will only be disclosed externally in the aggregate and presented in anonymous form and will not include (directly or by inference) any information identifying participating organizations or any identifiable individual as the source of such data.
   
   
6. Publicity and External Use by Client: Client acknowledges and agrees (i) that it will not make any public statement regarding these AskGartner Terms, AskGartner and/or its participation therein without Gartner’s prior written approval; (ii) that it will not quote from, summarize, paraphrase, or promote the output of AskGartner to any third party and (ii) that its participation and use of AskGartner constitutes neither a partnership with Gartner nor an endorsement by Gartner of Client or its services.
   
   
7. Internal Use of Output in Client Organization: Client acknowledges and agrees that Licensed Users may share an excerpted or derivative version of the AskGartner output, once checked against Gartner sources, in accordance with the Licensed User’s internal sharing limits set out in the Gartner Usage Policy, available at www.gartner.com/en/about/policies/usage-policy.
   
   
8. Liability Disclaimer: Client acknowledges and agrees that, because the output from AskGartner is generated by an artificial intelligence language model that may be incorrect or out of date, Client will independently verify all answers by consulting the provided links to Gartner research and/or consulting with a Gartner analyst. Gartner does not assume any responsibility or liability for the use or interpretation of the output from AskGartner.
   
   
9. Incorporated Terms: Client’s use of AskGartner is governed by these AskGartner Participation Terms, as well as the following, which are incorporated herein by this reference: (i) Client’s current contractual arrangements with Gartner, (ii) the Gartner Usage Policy, (iii) the Gartner Privacy Policy, (iv) the Gartner GenAI Statement and (v) the gartner.com Terms of Use (collectively, the “Incorporated Terms”). In the event a term is not defined hereunder, the parties agree to defer to the Incorporated Terms. In the event of a conflict, these AskGartner Terms will govern.
